DECREE BY THE PRESIDENT OF UKRAINE

On the Institution of the Presentational Fire-Arm, Award of the President of Ukraine

In accordance with Item 9-2, Article 114-5 of the Constitution of Ukraine

be it further enacted that:

1. The Presentational Fire-Arm, award of the President of Ukraine, is instituted.

2. The Presentational Fire-Arm, award of the President of Ukraine, is granted fordistinguished services in ensuring the high defence potential of Ukraine, inviolability of its national borders, maintaining high combat readiness of troops, strengthening its national security, fighting crime, protecting constitutional rights and liberties of the people; for irreproachable long service, exemplary fulfilment of military and service duties, demonstration of heroism and valour.

3. The Statute, the description, and the award certificate of the Presentational Fire-Arm, award of the President of Ukraine, are approved.

4. The Cabinet of Ministers is to provide funds for the manufacture of the Presentational Fire-Arm, award of the President of Ukraine, and award certificates.

STATUT

of the Presentational Fire-Arm, Award of the President of Ukraine

1. The Presentational Fire-Arm, award of the President of UKraine (hereafter the Presentational Fire-Arm), has been instituted for distinguished services in ensuring the high defence potential of Ukraine, inviolability of its national borders, maintaining high combat readiness of troops, strengthening its national security, fighting crime, protecting constitutional rights and liberties of the people; for irreproachable long service, exemplary fulfilment of military and service duties, demonstration of heroism and valour.

2. A pistol is used as The Presentational Fire-Arm. It is granted to officers of the Armed Forces of Ukraine, the Border Guards of Ukraine, other military formations established in accordance with the law of Ukraine, the Security Service of Ukraine, the Ministry of Home Affairs of Ukraine, and commissioned governmental employees.

3. Recommendations for granting the Presentational Fire-Arms are submitted by Ministers, Heads of other central executive bodies, commanders of military formations. The recommendation should mention concrete services of the person being the basis for the recommendation.

4. The Presentational Fire-Arm is received by a recipient from the President of Ukraine together with the award certificate and a basic ammunition load of 16 cartridges; or the President of Ukraine may entrust Ministers, Heads of other central and local executive bodies, local self-government authorities, commanders of military formations with awarding the Presentational Fire-Arms.

5. Small arms used as the Presentational Fire-Arm Award are to be registered in a Home Office of the recipient's residence area and kept in the manner determined by the Ministry of Home Affairs of Ukraine.

6. The holder of the Presentational Fire-Arm is entitled to xeep, carry, and use it. The holders are to keep strictly to the rules of its storage, handling, and use.
The way of using the arms while carrying out service duties or in other cases is defined by the law of Ukraine.
Handing over the Presentational Fire-Arms to other persons or their confiscation are forbidden.

7. A duplicate of the Presentational Fire-Arm award certificate is not provided in the event of its loss (damage). It may be provided as an exception if the holder was unable to prevent its loss (damage). A duplicate of the Presentational Fire-Arm is not provided.

8. A holder of the Presentational Fire-Arm can be deprived of the award when:
the holder is condemned for a serious crime, after the recommendation of the court and in the manner envisaged by the law;
the holder has broken the demands of item 6 of this Statute and the Law of Ukraine On Weapons.

9. The Presentational Fire-Arm and its award certificate belonging to a person deprived of the award are handed over to the Ftome Office as well as after the death of the holder.
