DECREE BY THE PRESIDENT OF UKRAINE

On the Institution of The Order For Bravery, Award of the President of Ukraine

In order to reward individuals for their personal bravery and heroismin extraordinary situations, which actions are aimed at the defence of people, theirrights and liberties, social interests and in accordance with Item 25, Article 106 of theConstitution of Ukraine

be it further enacted that:

1. The Order For Bravery, 1st, 2nd, and 3rd Class, award of the President of Ukraine (hereafter the Order For Bravery), is instituted.

2. The Statute and the description of the Order For Bravery, 1st, 2nd, 3rd Class are approved.

3. The Order For Bravery is awarded to servicemen, officers of law enforcing agencies and other persons for their personal bravery and heroism demonstrated while saving people, material effects during the elimination of the consequences of natural calamities, fires and in other extraordinary situations, while fighting crime, as well as while carrying out military, service, and civil duties in conditions putting their lives at risk.

4. Recipients of awards of the President of Ukraine such as the Star For Bravery and the Cross For Bravery are considered to be equal to the recipients of the Order For Bravery from the date when the Decree takes effect, and they are recognised as holders of the Order For Bravery retaining the right to wear decorations they have been granted.

5. Granting the Star For Bravery and the Cross For Bravery is to be discontinued following the institution of the Order For Bravery.

6. The Cabinet of Ministers of Ukraine is to provide financial and logistical support for making the insignia of the Order For Bravery, 1st, 2nd, and 3rd Class and award certificates.

7. The Decree takes effect the day of its signing.

STATUT

of The Order For Bravery, Award of the President of Ukraine

I. General Provisions

1. The Order For Bravery, award of the President of Ukraine (hereafter the Order For Bravery), has been instituted for awarding servicemen, officers of law enforcing agencies and other persons for their personal bravery and heroism demonstrated while saving people, material effects during the elimination of the consequences of natural calamities, fires and in other extraordinary situations, while fighting crime, as well as while carrying out military, service, and civil duties in conditions putting their lives at risk.

2. The Order For Bravery is conferred on citizens of Ukraine, as well as foreigners, and persons without citizenship.

3. The Order For Bravery is granted by the Decree of the President of Ukraine.

4. The Order For Bravery is instituted in three classes:
Order For Bravery, 1st Class;
Order For Bravery, 2nd Class;
Order For Bravery, 3rd Class. The 1st Class is the highest.
The Order For Bravery is granted sequentially starting with the 3rd Class.

5. The recipient of the Order For Bravery of any class is called the holder of the Order For Bravery.

6. The Order For Bravery, 1st Class has a cruciform badge of the Order and the star of the Order, that of the 2nd and the 3rd Class — only the badge of the Order.

7. The Order For Bravery can be granted posthumously.

8. The holder of the Order For Bravery can be deprived of the decoration by the President of Ukraine if the holder is condemned for a serious crime, after the recommendation of the court and in the manner envisaged by the law.

II. Procedure of Recommendation for Awarding the Order For Bravery

9. A recommendation for granting the Order For Bravery is submitted to the President of Ukraine by the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, the Supreme Court of Ukraine, the Constitutional Court of Ukraine, the Office of Attorney General of Ukraine, Ministries, other central executive bodies, the government of the Autonomous Republic of the Crimea, regional administrations, Kyiv and Sevastopol city administrations.
Servicemen and equivalent persons are granted the Order For Bravery after the recommendation of the Ministry of Defence of Ukraine, Headquarters of the Border Guards of Ukraine, the National Guard of Ukraine, leadership of the Security Service of Ukraine, the Department of the Governmental Security of Ukraine, the Ministry of Home Affairs of Ukraine.
The Commission for National Awards of Ukraine under the President of Ukraine may give its own recommendations for conferring the Order For Bravery.
The recommendation is to contain the list of services which have become the reason for recommending the person for the award.

10. A standard recipient's form is enclosed with the recommendation.

11. A recommendation to grant the Order For Bravery to a person is submitted to a higher authority or military commanding unit. As a rule, candidates are suggested by the institution (unit) where the person to be awarded is employed (serves).
Suggestions for awarding the Order For Bravery are also allowed to be made by local authorities.

III. Procedure for Awarding the Order For Bravery

12. The Order For Bravery is awarded in public with all the proper solemnities.

13. The Order For Bravery is awarded by the President of Ukraine.
The President of Ukraine can entrust the Speaker of the Verkhovna Rada of Ukraine or Vice-speakers, the Prime Minister of Ukraine, the First Vice Prime Minister of Ukraine, Vice Prime Ministers of Ukraine, the Chairman of the Supreme Court of Ukraine, the Chairman of the Constitutional Court of Ukraine, Attorney General of Ukraine, the Head of the Commission for National Awards of Ukraine under the President of Ukraine, Ministers, Heads of other central executive body, the Speaker of the Verkhovna Rada and Chairman of the Council of Ministers of the Autonomous Republic of the Crimea, Heads of regional administrations, Kyiv and Sevastopol city administrations, commanders of respective military units with awarding the Order For Bravery.

14. The recipient of the Order For Bravery receives:
for the Order, 1st Class: a cruciform badge of the Order, the star of the Order, the award certificate;
for the Order, 2nd and 3rd Class: a cruciform badge of the Order, the award certificate.

IV. Ways of Wearing the Order For Bravery

15. The cruciform badge of the Order For Bravery, 1st Class is a cravat type decoration; the star of the Order is worn upon the left breast.

16. The cruciform badge of the Order For Bravery, 2nd and 3rd Class is worn upon the left breast.

V. Providing Duplicates of Insignia and Award Certificates of the Order For Bravery

17. As a rule, duplicates are not provided in the event of loss (damage) of insignia and the award certificate of the Order For Bravery. They may be provided as an exception, if the holder was unable to prevent the loss (damage) of insignia and the award certificate.

18. Duplicates of insignia of the Order For Merit and the award certificate are provided by the Commission for National Awards of Ukraine under the President of Ukraine at its own discretion at the expense of the holder or free of charge.

VI. Storage of Insignia and Award Certificates of the Order For Bravery

19. Insignia of the Order For Bravery (crosses, stars, and award certificates) are stored in the Award Department of the Administration of the President of Ukraine.

20. In the event of granting the Order For Bravery posthumously, the insignia and the award certificate of a respective class are handed over to the family of the recipient.

21. The insignia and the award certificate of the Order For Bravery remain after the death of the holder in his/her family as a memory. The insignia and the award certificate are to be returned to the Administration of the President of Ukraine if the late holder had no family.

22. Heirs to the late holder, or the one awarded posthumously, may hand over the insignia and the award certificate of the Order For Bravery to national Ukrainian museums for temporary exhibition. The procedure of handing them over, commitments of the parties, the term of exhibiting the insignia of the decoration and other conditions are determined by a specific agreement.

23. The insignia and the award certificate of the Order For Bravery belonging to a person deprived of the Order are to be returned to the Administration of the President of Ukraine.
